3. TYPES OF PERSONAL DATA WE COLLECT

How we collect data above you will find all the different ways in which you can receive or obtain data. Some of this data may be personal data and we explain below the types of personal data we collect about you. Of course, the type of personal data we collect about you will depend on how you interact with us.

Personal data or personal information, which is any information about an individual that identifies that person. It does not include data where the identity has been removed (anonymous data).

We collect a variety of personal information about our customers and visitors to the PinkCozyFire site.

This personal information falls into these categories:

  • Identity-related data includes title, gender, first name, maiden name, last name, date of birth, username or similar identifier, and login/password. If you interact with us through social media, this may include your social media username.
  • Contact data includes billing address, delivery address, telephone numbers and email address.
  • Financial data includes payment card and bank account/direct debit details.
  • Transaction Data includes information about payments made to and received from you and other details of products and services you have purchased from us.
  • Profile data includes your username and password, purchases or orders placed by you, your interests, preferences, feedback and survey responses, and any profile data we have added (for example, using analytics and profiling).
  • Technical data includes internet protocol (IP) address, login details, browser type and version, time zone setting and location, browser plug-in types and  versions, operating system and platform and other technologies on the devices you use to access this website.
  • Usage data includes information about how you use our site, products and services, and any content you add to the forum.
  • Tracking Data includes information that we or others collect about you through cookies and similar tracking technologies, such as web beacons, pixels and mobile identifiers.
  • Marketing and Communications Data includes preferences in receiving direct marketing from us and our third parties and communication preferences.

We also collect, use and share aggregate data such as statistical or demographic data for any purpose. Aggregate data may be derived from personal data but is not considered personal data from a legal standpoint because it does not, directly or indirectly, reveal your identity. For example, we may aggregate usage data to calculate the percentage of users who access a specific feature on our site.

However, if we combine or link the aggregated data with your personal data in a way that makes it possible to identify you directly or indirectly, we will treat the combined data as personal data that will be used in accordance with this privacy policy.

We do not collect special categories of personal data about you (this includes information about your race or ethnic origin, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). And we do not collect information about criminal convictions and offenses. We are unable to determine whether you share personal data processed in this category so we will treat it as personal data. If you share this data on the forum, you have chosen to make it public online and anyone can read it.

Remember, if you choose not to share personal data with us, or do not authorize certain contacts, we may not be able to provide the products and services you have requested.

4. EXPLAIN THE LEGAL BASIS FOR THE USE OF PERSONAL DATA

We will only use your personal data when the law allows it. In general, we will use your personal data in the following circumstances:

  • When we need to fulfill the contract we are entering into or have entered into with you. For example, when you purchase our products, this constitutes a product supply contract between you and us.
  • When it is necessary for our legitimate interests (or those of third parties) and your interests and fundamental rights do not override those interests. For example, checks against fraud as part of checkout or to keep our website secure.
  • When we need to comply with a legal or regulatory obligation. For example, maintaining a record of our sales for tax compliance.

We do not generally rely on consent as a legal basis for processing personal data except where it is required by law, for example in relation to sending certain direct marketing communications. Where our legal basis is consent, you have the right to withdraw consent at any time.

Read how and why we use personal data below for more details.

5. HOW AND WHY WE USE YOUR PERSONAL DATA

The following table provides a summary of the details of how we use personal data, the types of personal data to which this relates and why we may do so. When we explain why, we will identify the relevant category to explain the legal basis for the use of your personal data and, where we base our use of personal data on the possibility of doing so for our legitimate interests, we will highlight that legitimate interest.

We may process your personal data for more than one legal basis depending on how we use it.

6. ADVERTISING, MARKETING AND COMMUNICATION PREFERENCES

There are many different ways in which ads on PinkCozyFire are presented to users, and these may not use personal information – sometimes we buy advertising space in the real world and on websites and in social media. If you see a PinkCozyFire ad on websites and in social media, it may not be specifically targeted at you, but we may just have made an offer for the space. We may also use ‘look-alike’ products from search engines and social media platforms, which are not targeted at you and which you can control using the privacy settings of each search engine or social media platform.

We use your identity, contact, technical, tracking, usage and profile data to form a picture of what we think might be useful or desired, or interesting. In this way we decide which products, services and offers may be relevant to you, and provide you with information about them. We may conduct direct marketing activities via email, telephone, text message and mail.

On our site, we clearly set forth your direct marketing preferences. You may choose to receive our newsletter, or as part of creating an account. We may also be able to send our customers relevant direct marketing about our products and services unless they have opted out of receiving this type of communication during purchase. We may also send you a notification as part of the purchase if you have left products in your cart without completing the check-out.

At any time, you have the right to choose not to receive direct marketing (opt out). The easiest way to opt out is to use the appropriate link at the bottom of the communication or simply contact us by email at [email protected].

We will require your express consent before we share personal data with companies outside the PinkCozyFire Group for direct marketing purposes.

We also work with partners to try to increase the reach of our ads and use analytics and retargeting for this purpose. We use tracking data to deliver relevant online advertising, including on websites and social media.

Tracking data, and in particular cookies, help us deliver website and social media advertising that we believe is relevant to you and potential new PinkCozyFire customers. The cookies used for this purpose are often placed on our websiteeb by specialized organizations – and this is also because, after visiting the PinkCozyFire website, you may see content from our website again. This is called retargeting.

Cookies can also tell us if you’ve seen a specific ad before, and how long it’s been since you last saw it. This is useful, because it means we can monitor the effectiveness of our ads and control the number of times our ads are shown. Cookies also help us know if you’ve opened a marketing email because we don’t want to send you things you don’t read.

For more information about tracking data, and cookies in particular, visit our cookies page below.

Almost all cookies that relate to advertising are part of third-party online advertising networks. To learn more about how you can control which ads appear online, view the opt out programs established by the European Interactive Digital Advertising Alliance and the Digital Advertising Alliance (United States). We do not control the cookies set by ad networks.

7. COOKIE

A cookie is a small file of letters and numbers that we save through your browser.

Our site uses cookies to help us distinguish you from other users of our site. This helps us to give you a great experience when you visit our site and also allows us to improve our site.

We use the following categories of cookies:

  • Strictly necessary cookies. These are the cookies that are necessary for the proper functioning of our website. They include, for example, cookies that allow you to log in to the site, use the shopping cart or make secure payments.
  • Analytical/performance cookies. They allow us to recognise and count the number of visitors and to see how visitors move around our website when they are using it. This helps us to improve the way our website works, for example, by ensuring that users can easily find what they are looking for.
  • Functionality cookies. These are used to recognise users when they return to our website. This allows us to personalise our content for you, call you by name and store your preferences (for example, your choice of language or country). These also let us know if you’ve left all the products in your cart without checking out.
  • Profiling cookies. These cookies record your visit to our site, the pages you visited and the links you followed. We will use this information to make our website relevant to your interests and for advertising and retargeting purposes. We may also share this information with third parties for this purpose.

Please note that third parties (including, for example, advertising networks and external service providers such as web traffic analysis services) may also use cookies, over which we have no control. These cookies are likely to be analytical/performance or profiling cookies.

Cookies can be blocked by activating the setting on your browser that allows you to refuse the setting of some or all cookies. However, if you use your browser settings to block all cookies (including essential cookies) you may not be able to access some or all of our site. For more information on how to block cookies, please visit the ‘help’ section of your browser or All About Cookies.

By deleting cookies, two things will happen:

  • We will no longer know that you have opted out of online behavioral advertising, so our ads will still appear on other websites.
  • We will no longer automatically recognize the preferences you set on our site.

8. DISCLOSURE OF PERSONAL INFORMATION

We may share personal information with PinkCozyFire.

We may share personal information with the following categories of third parties for the purposes set forth in this Privacy Policy:

  • Companies and companies that process Personal Data on our behalf, including technology services companies, logistics services companies, postal services and transportation companies, auditors and professional advisors such as banker, lawyer, accountants and insurance companies,
  • Government departments and agencies, authorities and law enforcement agencies where we are required by law to share personal information.

We require all third parties to respect the protection of personal data and to process it in accordance with the law. We do not allow our third party service providers to use your personal data for their own purposes and only allow them to process your personal data for certain purposes and in accordance with our instructions.

We also share data with third parties related to advertising, retargeting and analytics. See cookies above, including the list of cookies, for more information on who those third parties are.

We also share data with third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. Alternatively, we may seek to acquire other companies or merge with them. In the event of a change in our business, the new owners may use personal data in the same manner as set forth in this Privacy Policy.

9. INTERNATIONAL PAYMENTS

We may share your personal data within PinkCozyFire. We have operational bases in the UK, Germany and the USA, so this will involve the transfer of data outside the European Economic Area (EEA). We share data between the EEA and the US within our group of companies under a contract signed by our group of companies.

Many of our external third parties are based outside the EEA, so their processing of personal data will involve a transfer of data outside the EEA.

Whenever we transfer your personal data outside the EEA, we ensure that it will be treated in accordance with a similar degree of protection and we will comply with the General Data Protection Regulation (GDPR).

10. DATA SECURITY

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or viewed in an unauthorized manner, altered or disclosed. In addition, we restrict access to your personal data to employees, agents, contractors and other third parties who have a business reason to view it. Your personal information will be handled according to our instructions and is subject to a duty of confidentiality.

We have procedures in place to deal with any suspicion of a personal data breach and both you and any applicable regulator will be notified of the breach where we are legally required to do so.

11. DATA RETENTION

We will only retain your personal data for as long as is necessary to achieve the purposes for which we collected it, including for the purposes of fulfilling any legal, accounting or reporting requirements.

In determining the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm caused by its unauthorized use or disclosure, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and applicable legal requirements.

By law we must keep basic customer information (including contact, identity, financial and transaction data) for six years after they cease to be customers for tax purposes.

12. HOW TO CONTACT PINKCOZYFIRE ABOUT PRIVACY

If you have any questions about this privacy policy, or to exercise your rights, please contact us by email at [email protected].

If you need help with our products and services or this website in general, please contact us here.

You have the right to send a complaint at any time to the Information Commissioner Office (ICO), the UK supervisory authority for data protection issues (www.ico.org.uk). However, we would appreciate the opportunity to discuss your concerns with you before you approach the ICO, so please contact us first.

13. THIRD PARTY LINKS

This Site may include links to third party websites, plug-ins and applications. sClicking on those links or activating those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website, we encourage you to read the privacy policy of each site you visit.

14. IF YOU DO NOT PROVIDE YOUR PERSONAL INFORMATION

Where we need to collect personal data by law, or under the terms of a contract we have with you and you have not provided such data when requested, we will not be able to perform the contract we have entered into or are seeking to enter into with you (for example, to provide goods or services). In this case, we may have to cancel a product or service you have established with us, but we will notify you if this is the case.

15. CHANGE OF PURPOSE

We will only use your personal data for the purposes for which we collected it, unless we reasonably believe that we need to use it for another reason compatible with the original purpose.

If we need to use your personal data for unrelated purposes, we will inform you and explain the legal basis for doing so.

Please note that we may process your personal data without informing you or without your consent, in accordance with the above rules, where this is required or permitted by law.

16. YOUR LEGAL RIGHTS

Under certain circumstances, data protection laws give you certain rights in relation to personal data.

  • Requesting access to your personal data

This enables you to receive a copy of the personal data we hold about you and to verify that we are processing it lawfully.

  • Request correction of personal data

This allows us to correct any incomplete or inaccurate data we hold about you, although we may need to check the accuracy of new data you provide to us.

  • Request deletion of your personal data

This allows you to ask us to delete or erase personal data where we do not possess any good reason to continue to process it. You also have the right to ask us to delete or erase your personal data where you have properly exercised your right to object to the processing of the data (see below), where we may have processed the information unlawfully or where we are required to erase the personal data in accordance with local law. Please note, however, that we will not always be able to comply with your erasure request for specific legal reasons, which you will be notified of, if applicable, at the time of your request.

  • Objecting to the processing of personal data

This allows you to object to the processing of personal data where we have relied on a legitimate interest (or those of a third party) and your particular circumstances mean that you may decide to object to processing on this basis if you believe it affects your fundamental rights and freedoms. You also have the right to object if we are processing personal data for direct marketing purposes. In some cases, we may be able to show that we have compelling legitimate grounds for processing the information that outweigh your rights and freedoms.

  • Request restriction of processing of personal data

This allows you to ask us to stop processing your personal information in the following scenarios: (a) where you want us to establish the accuracy of the data; (b) where our use of the data is unlawful but you do not want us to delete it; (c) where you need us to retain the data even if we no longer require it because it is necessary to establish, exercise or defend legal claims; or (d) you have objected to the use of your data but we need to verify whether we have legitimate reasons to use it.

  • Requesting the transfer of personal data

We will provide you, or a third party of your choice, with personal data in a structured, commonly used and computer-readable format. N.b. this right only applies to automated information for which you have previously provided consent and if we have used this information to fulfill a contract with you.

  • Right to Withdraw Consent

Withdraw consent at any time where we rely on consent to process your personal information. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw consent, we may not be able to offer you certain products or services. We will inform you if this is the case when you decide to withdraw your consent.

If you wish to exercise each of the above rights, you may contact PinkCozyFire about privacy as indicated above.

You will not need to pay a fee to access your personal information (or to exercise your other rights). However, we may charge a reasonable fee if the request is clearly unfounded, repetitive or excessive. Alternatively, we may decline to comply with your request in these circumstances.

We may need to ask you for specific information to help us confirm your identity and ensure that you have the right to access your personal data (or any other rights). This is a security measure to ensure that personal data is not disclosed to any person who does not have a right to receive it. In addition, we may contact you to obtain more information in connection with your request to expedite our response.

We try to respond to all legitimate requests within one month. Sometimes we may need more than one month if the request is particularly complex or if you have made a number of requests. In this case, we will inform and notify you of our progress.
